Incorporation Procedure

Formation of a company is a process which results in incorporation of a company. In India, we presently have the Companies Act, 2013 to govern companies in India. Following types of companies are defined under the said Act :

• One Person Company -Section 2(62)
• Private Company- Section 2(68)
• Public Company- Section 2(71)
• Government Company - Section 2(45)
• Companies with charitable object- Section 8
• Producer Company- Section 465(1)

1. Selection of type of Company

2. Apply for allotment of DIN and Digital Signature of proposed directors in e-Form DIR-3
3. Apply for reservation of name in RUN Service. If proposed name is not available, the user has to apply for a fresh two name on the same application.

4. After reservation of the name of the proposed company, within 15 days’ company need to file e-form INC-32 (SPICe) , INC- 33 (MOA) , INC-34 (AOA) for incorporation of the OPC / other than OPC respectively.

5. After processing of the Forms is complete and Corporate Identity Number, PAN and TAN is generated by the Registrar of Companies and Income Tax Department and Certificate of Incorporation issued.
